If a child of compulsory school age who is registered at a school fails to attend regularly at the school, or fails to attend regularly at alternative educational provision, the parent is guilty of an offence under s444 of the Education Act 1996. A Penalty Notice gives a parent the opportunity to pay a fine instead of being prosecuted for the offence.

For a first penalty notice issued within a rolling three-year period, it may be paid at £80 within 21 days of being issued, and payable at £160 between after this and up to 28 days from being issued.  For a second penalty notice issued within a rolling three-year period, it is payable at £160 up to 28 days from being issued.

A Penalty Notice is specific to each individual child issued with a Penalty Notice and not a household. It is your responsibility to ensure that the correct reference number is entered and paid for each Penalty Notice. Please be aware that we are unable to accept late payment or payment by instalment. If payment is not made at the appropriate rate and within the timescales set out in the Penalty Notice you may be prosecuted for the original offence and be subject to a fine of up to £1000.
